Warren Hill is set to be executed despite his low IQ of 70, due to Georgia's strict criteria for "mental retardation". John Eley, a former death row inmate in Ohio had his sentence commuted to LWOP due to Eley's limited mental capacity. Executing mentally retarded prisoners was ruled as cruel and unusual punishment by the US Supreme Court, but the Court has left it up to individual states to produce their own definition.

Nine out of ten of the remaining Connecticut death row inmates are suing the state over alleged racial and geographical biases. They are calling for the trial of this case to be held within the prison; currently it is planned to be held in a courthouse and shown to prisoners on a TV screen.
